Vitória Quilombola em Paracatu: Justiça Obriga Proprietário a Reconstruir Acesso Crucial à Comunidade de Pontal

Uma importante vitória para os direitos territoriais e o modo de vida da Comunidade Quilombola de Pontal, em Paracatu, no Noroeste de Minas, foi alcançada na Justiça Federal. Uma liminar obtida pelo Ministério Público de Minas Gerais (MPMG) obriga um proprietário de terra da região a reconstruir uma estrada e uma ponte que historicamente interligam os diversos núcleos familiares do território quilombola. A decisão judicial reconheceu a posse coletiva exercida pela comunidade sobre essa via tradicional, essencial para a organização social e econômica local.
A ação civil pública (ACP) movida pelo MPMG detalha que a estrada e a ponte em questão foram construídas em 1957 e, desde então, jamais houve qualquer tipo de oposição ou impedimento ao tráfego de pessoas e veículos. Essa situação perdurou até agosto de 2023, quando o proprietário da terra onde se localizam os acessos bloqueou o trânsito, impactando diretamente a vida da comunidade.
“A estrada e a ponte tiveram grande importância na organização territorial da comunidade, sendo o principal caminho utilizado para o deslocamento interno entre os núcleos para os mais diversos fins”, ressalta um trecho da ACP. O impedimento do trânsito não apenas cerceou o direito fundamental de ir e vir dos moradores, mas também prejudicou outras dimensões cruciais da vida em comunidade, como o acesso a atividades religiosas, a geração de renda, a prática de esportes e o lazer. As relações sociais, intrinsecamente ligadas à facilidade de deslocamento entre os núcleos familiares, foram severamente afetadas.
Ao analisar as provas robustas apresentadas pelo MPMG, a Justiça Federal não hesitou em constatar a ilegalidade da ação do proprietário. A decisão liminar determina que o homem realize a reconstrução da ponte e da estrada, restabelecendo o acesso vital para a Comunidade Quilombola de Pontal. Além disso, a liminar proíbe qualquer nova tentativa de impedir o trânsito no local. Em caso de descumprimento da decisão judicial, o proprietário está sujeito a uma multa expressiva, que pode alcançar a cifra de R$ 500 mil. A decisão judicial também reconheceu a servidão de passagem, garantindo legalmente o direito de tráfego da comunidade no local.
Para a promotora de Justiça Mariana Duarte Leão, que propôs a ACP juntamente com o promotor de Justiça Lucas Sanches Tizzo, com o apoio do Centro de Apoio Operacional às Promotorias de Justiça de Apoio Comunitário, Inclusão e Mobilização Sociais (CAO-Cimos), a decisão representa um marco significativo. Ela a classifica como uma vitória na afirmação dos direitos territoriais quilombolas, no enfrentamento ao racismo ambiental e estrutural, e na efetivação do direito de ir e vir e do modo de vida tradicional da Comunidade de Pontal.
A liminar obtida pelo MPMG em favor da Comunidade Quilombola de Pontal em Paracatu é uma conquista emblemática na luta pelo reconhecimento e respeito aos direitos das comunidades tradicionais. A decisão da Justiça Federal não apenas obriga a reconstrução de acessos essenciais, mas também reafirma a posse coletiva da comunidade sobre seu território e o direito fundamental de viver de acordo com seus costumes e tradições.
